Terms of Use

1. License

PicSift is licensed, not sold, to you. Your use is governed by Apple's Standard Licensed Application End User License Agreement ("Standard EULA"), except where these Terms provide additional terms.

2. Description of Service

PicSift uses on-device machine learning to analyze and score your photos for overall appeal, sharpness, lighting, composition, and other attributes. It provides tools for curation, search, face grouping, duplicate detection, and export.

3. Service Tiers

• PicSift (Free) — Core scoring, curation, and export with session and export limits
• PicSift (Unlocked) — A one-time purchase that removes the limits and adds People Hub, Advanced Search, Smart Album rules and star ratings in exported files.

The App Store product page and the app describe features, limits, and pricing. We may adjust contents and pricing for future purchases; we honor existing purchases at their original terms. We may introduce additional tiers in the future. Apple's App Store processes all purchases.

4. Scoring Disclaimer

Machine learning models generate PicSift's scores, tiers, scene categories, and rankings. These are approximate, automated assessments. They are not professional evaluations.

You acknowledge that:

• Scores are probabilistic estimates, not objective measures of photo quality
• Different scoring models and settings produce different results
• Scene classification, face detection and grouping, and duplicate detection may produce incorrect results
• Scores should inform your decisions but are not a substitute for your own judgment

We are not responsible for decisions you make based on PicSift's scores, including deleting, archiving, or sharing photos based on their tier.

5. Your Content

You retain all rights to your photos and curation decisions. We claim no ownership of or license to your content. PicSift does not upload your photos. It keeps working copies on the device, such as previews and, on iPad, the photos you import. It sends a photo elsewhere only when you share or export it.

6. Machine Learning Models

PicSift includes and optionally downloads models derived from published academic research, provided under their respective open-source licenses. We may update, replace, or retire models in future versions. Model changes may alter scores; you can score your photos again at any time.

7. Acceptable Use

You agree not to:

• Reverse-engineer, decompile, or disassemble PicSift or its models
• Extract, redistribute, or commercially exploit bundled models separately from PicSift
• Use PicSift in any way that violates applicable law
• Misrepresent PicSift's scores as professional assessments or certifications

8. Disclaimer of Warranties

PicSift is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Syrinx Ventures, LLC is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of PicSift. Our total liability will not exceed the amount you paid for PicSift in the twelve months preceding the claim.

10. Third-Party Components

PicSift uses third-party open-source software and models under their respective licenses, listed in the app's Acknowledgements section.

11. Changes to These Terms

We may update these Terms. Continued use after changes means you accept them. PicSift's release notes list material changes.

12. Governing Law

These Terms are governed by the laws of the State of Washington, United States.
